The current general conditions of sale regulate all relations between:
Antonio López Montero S.L., through its on-line shop www.alopezmontero.com ("ALM" from now on) and its on-line customers.
Please read these terms carefully before you start using the Website (this includes accesing and browsing), as they set out the rules which will apply to your use of the Website. By using the Website, you are indicating that you accept and agree to comply with the Terms of Use.
1. SPECIFIC SELLING CONDITIONS
The customer recognises, when placing an order, the particular selling conditions stated on the screen (name, price, components, weight, quality, colour, details of the product, cost of the service, etc.) and consent to accept all of them. Placing the order and its subsequent confirmation, materialize the full and complete acceptance of the particular conditions of sale, only applicable to the order.
The web www.alopezmontero.com is intended for individuals or companies' sales, regardless of their activity or sector.
2. PLACING AN ORDER OR ASKING FOR AN ONLINE QUOTATION
By clicking on the "Order with obligation of payment" button on the website, the customer undertakes to make the payment of the goods and shipping costs (if applicable) using the chosen payment method.
Once the payment has been received, the order shall be prepared within 48 hours and then shipped by the corresponding transport agency.
In the event of not having any stock of the items ordered by a client, we will act according to the instructions given by the client when placing the order, nevertheless, if necessary, we will contact the client in order to provide them with a better service.
We would also like to remind our customers that any other type of order, different from "stock offers" will take 6/7 weeks to be manufactured, starting from the client's final order confirmation which will required the 30% deposit from the final proforma sent. Only when the payment is received, the manufacturing process will start.
3. ORDER CONFIRMATION
Once the order has been placed on-line, a confirmation email will be sent to the email address provided by the customer, with all the details of the order. Customers are requested to check their Spam in-box when not getting the confirmation email in case that might be the problem. If that was not the case, the customer may ask for the email to be resent. The customer will be free to access their personal account to check their orders records. Customers will be able to download their invoice once it is available.
4. DELIVERY
Orders are prepared and packed from Monday to Friday. Orders will not be collected from us during weekends (Saturday or Sundays) or holidays (National or local holidays will be previously announced in our news section). Couriers will not be able to collect any parcel after 16h00 p.m. Once in delivery, the order must be delivered within the period specified in the description of the transport service chosen when placing the order on the web. Delivery time will depend on the transport agency chosen.
Once the order is packed and ready to be shipped, delivery time will depend on the transport agency chosen by the customer among the ones offer on the web. We are not responsible if the customers choose one or another courier service by mistake and we reserve the right to modify the agency whenever it is for an improvement in customer service.
5. PAYMENT
ALM does its very best to offer the safest payment methods to our customers. Customers are free to choose the payment platform that best suits them, they will be able to ask for a change to ALM in case of error. ALM does not get any commission in price by using one payment method or another.
When dealing with stock orders, the order will be prepared and shipped as soon as the payment, no matter the platform, is received, with the exception of the bank transfer, which will be effective after 24/48 hours, once the payment has been received. Customers are free to send the bank receipt to expedite the processing of the order but does not guarantee the payment or shipment of the order.
Possible payment methods: Credit card, Paypal and bank transfer.
6. SHIPPING COST
Shipping costs will be established according to the weight of the parcel and the transport agency chosen by the customer. When placing the order, the web will show all different agencies available and their prices.
When placing an order, the customer agrees to sign the receipt sheet presented by the person who makes the delivery, in which he / she may include all the observations he / she deems necessary. By signing the receipt sheet, the customer acknowledges having received the number of packages indicated therein. If the customer observes that the package is damaged or open, they must write it on the delivery note. In order to present a claim to the transport agency, please send us an email to info@alopez-montero.com with a couple of photos of the parcel and the damaged items, as soon as possible, as 24 hours after delivery, the agency could exempt its responsibility for the claim or incident and an optimal solution for the client, will be difficult to obtain.
When delivery of the goods to the customer cannot be made due to the latter, ALM reserves the right to bill the customer for the shipping and return costs of the order.
7. PRICE
All prices will be provided in Euro. The amount on the final invoice may vary from the one on the confirmation of the order due to gold fluctuation and amounts sent.Also, due to computer systems synchronization reasons, there may be differences of a few cents of € between the amount paid and the amount reflected on the invoice.
8. PRODUCTS DATA SHEET
Photos on the web are for illustrative purposes only. The written part that follows these photos is the information which determines the format, and the actual piece of jewellery. Differences between the photos and the actual product should be hardly noticeable and do not affect the essential characteristics of the products, in case it does not coincide due to some type of error, the description of the article always prevails over the photograph. Colours in the on-line shop should not be very different from the actual colour of the product.
9. RETURNS AND REFUNDS
You may cancel a contract at any time from the date of the Despatch Email until the date which falls 14 (fourteen) calendar days after the day the Goods are delivered to you.
If you have returned the Goods to us because they are faulty or miss-described, we will refund the price of the Goods in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us. Unless the Product is faulty or not as described, you will be responsible for the cost of returning the Products to us. If we have offered to collect the Goods from you, the expenses will also be on the customer and ALM will refund the corresponding amount. So, when the goods are correctly served and it is the customer who does not like them, ALM will refund the complete amount of the goods and the shipping costs as far as they have been returned within the established period (14 calendar days from receipt of the product) but not the return shipping costs, which will be on the customer.
In the event that ALM were to make a delivery in a place and during a previously agreed time and confirmed by a customer in accordance with the provisions of these Terms and Conditions, and the above mentioned was not in such place ( hereinafter "unreported absence") and during the previously agreed hours, ALM unilaterally reserves the right to reimburse the purchase amount to said customer, subtracting in any case from the corresponding amount, the expenses that would have accrued as consequence of the transport and / or the preparation of the purchase, as well as the return costs. Shipping costs will be stablishes according to each transport agency, weight of the parcel and distance.
ALM will only accept returns under the following circumstances:
- The goods must be just as it was when delivered and it should be kept, when possible, in its original packaging.
- Returns must be carried out using the same or a similar box to the one we sent to guarantee the perfect arrival of the goods.

The goods to be returned will be, always and under any circumstances, in perfect condition. It is not necessary to return them in their original packaging, as long as they do not suffer a depreciation, except as provided in article 79 of Royal Decree 1/2007, of November 16. In the case of damaged items,we will proceed to its inmediate replacement or refund dpenending on the customer.
10. INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights in the Website, and the material published on it including all software, design, text, images, photographs, illustrations, audio clips, video clips, artwork, graphic material and other copyrightable or otherwise legally protectable elements contained therein and arrangements. All such rights are reserved.
11. BUYER AND SELLER OBLIGATIONS
It is the buyer's obligation to pay the total price of the order including shipping costs (if they are not free) and to receive the order.
The seller agrees to safeguard and deliver the goods as specified in the order and to deliver a simplified or nominative invoice to the buyer.
12. LIABILITY, LITIGATION AND APPLICABLE LEGISLATION
Antonio López Montero SL can not be held responsible for the breach of the contract entered into in the event of a shortage of stocks or not having the product, disturbance or total or partial strike, in particular, of postal services and means of transport and / or communications, flood or fire, among others.
13. LEGAL GUARANTEES
In case of defective products, we shall proceed, as appropriate, repairing, replacing, reducing the price or ending the contract, all of which will be free of charges for the consumer.
The seller is liable for any lack of conformity that appears within a period of two years from delivery.
Customers must inform ALM of the lack of conformity within two months of becoming aware of it.
The above Terms and Conditions are governed by the Spanish law.
In the event of litigation, the user will directly contact our customer service to obtain a friendly solution.
These general conditions of sale will be translated into English language and will be carried out in accordance with Spanish law. Any disagreement that may arise due to its validity, its translation or its execution will be presented to the courts of the client's domicile, to which exclusive attribution of jurisdiction is expressly made.
